Is this considered contempt of court?

The judge ordered my child’s father to pay an ongoing amount of 199.50 every month. November he paid the full amount, December he took $50 out, January he paid the full amount and in February he took $100 out. My child’s father works for his other sons grandfather and in the past they were trying to get me to NOT report them to DSS. My case worker is going to call Monday morning and I need to explain this to her. The last time I tried to tell her what happened and why he’s not in jail she told me this,” We need to get the money”. After she told me that I haven’t heard from her or my child’s father until a year later. He had been working the whole time. I turned him in after I caught him and nothing happened to him. This has been going on for years/$13,500 in arrears now. A lot of that was recovered because my child’s father was claiming other kids on his income tax and the state took it from him.

How do I get the state to make him OBEY the judges orders?

This is a state law matter, but generally the case worker can file a motion to have him held in contempt. In Louisiana, they can take away his driver’s license and any other state issued licenses he may have (like ABO card, professional license, etc,). I agree with the case worker that him being in jail doesn’t help anybody, including you. He may be behind, but half is better than nothing, which is what you would get if he was in jail. Talk to the case worker and ask if she will file a motion for contempt. And tell her about his job with the other grandfather. They may be able to garnish his wages. Obviously you could hire an attorney, but that would cost more than it’s worth since the case worker is free. You got his fraudulent income tax refund, so you are getting some money slowly but surely. Hang in there! And good luck!
